These terms and conditions (‘Terms’) set out the terms and conditions of your (‘you’ or ‘your’) participation in the Airwallex Cashback Program (‘Program’) operated by the relevant Airwallex entity as set out in Annex 1. (‘Airwallex’, ‘us’, ‘our’ or ‘we’). The Airwallex Cashback Program allows you to receive a credit into your Airwallex Account, subject to your eligibility under, and compliance with, these Terms.

By participating in the Program and/or receiving Cashback (defined below), you agree to these Terms.

Who is eligible to participate in the Airwallex Cashback Program?

Participation in the Airwallex Cashback Program is by invitation only. Airwallex reserves the right to determine who it selects to participate in the Program. Only Airwallex customers whose country of residence/establishment is the United Kingdom or the European Economic Area are permitted to participate in the Program. 

What is the Cashback?

If you are invited to participate in the Program, you will receive 10% back on spending your first USD 1,000 (or its equivalent in a different currency) on Eligible Purchases using an Airwallex Card up to a maximum of USD100 (‘Cashback’). Any Cashback that you are entitled to will be paid into your Airwallex Account and in USD.

For instance, if you make an Eligible Purchase valued at USD 2,000, you will receive a Cashback of USD 100 into your Airwallex Account.

What is eligible international card spend?

In order to receive a Cashback, you must make Eligible Purchases using the Airwallex Card issued to you in connection with the Program. An Eligible Purchase is any card-based payment that is transacted with your Airwallex Card that:

1. is made within thirty (30) days of you passing KYC with Airwallex; 

2. is transacted with a transaction merchant country that is not the United Kingdom  in accordance with Airwallex’s transactions records, if your Airwallex Card is issued to you by Airwallex (U.K.) Limited; and

3. is transacted with a transaction merchant country that is not in the Netherlands in accordance with Airwallex’s transaction records, if your Airwallex Card is issued to you by Airwallex (Netherlands) B.V. 

How is the Cashback calculated?

In determining the USD value of an Eligible Purchase, Airwallex will convert the amount paid in the transaction currency into USD.

Airwallex, acting reasonably, may at any time and without prior notice to you, disqualify a transaction as an Eligible Purchase where it becomes necessary to do so.

When will you receive the Cashback?

Airwallex will process the Cashback as soon as possible, however it may take up to thirty (30) days from the end of the calendar month in which you make an Eligible Purchase for the Cashback to be credited into your Airwallex Account.

Does it cost to participate in the Program?

Airwallex does not charge you to participate in the Program.

Airwallex accepts no responsibility for any tax implications that may arise from the receipt of a Cashback. You should seek independent financial advice on any potential tax impacts of this Program on you.

What are some other restrictions you should know?

Unless otherwise agreed in writing with you, Cashbacks in connection with the Program are not available in conjunction with any other offer, package or promotion. We reserve the right (in our absolute discretion) to reverse any Cashback that has been credited to you, if any Eligible Purchases are subsequently cancelled, suspended, frozen or refunded.

Termination and changes

The Program expires on 31 December 2024, 23:59 GMT, unless extended or shortened by Airwallex. Your participation in the Program is not guaranteed and may be revoked at any time in Airwallex’s sole discretion in accordance with these Terms.

Airwallex may at any time and without prior notice, cancel, suspend, or change the Program where it reasonably considers it necessary to do so (for example, if we determine that the Program is no longer commercially feasible or because it may violate any applicable law). However, such discontinuation, suspension or change will not affect any Cashback that you have already validly earned prior to the time of such discontinuation, suspension or change in accordance with these Terms.

Further, Airwallex reserves the right, at our sole discretion and to the fullest extent permitted by applicable law, to disqualify you from participating in the Program if we suspect that you are using the Program in a fraudulent or unlawful manner or for a fraudulent or unlawful purpose, or if you are in breach of any of these Terms or any other terms and conditions that you have agreed to with Airwallex, and cancel, suspend, or change these Terms as appropriate to mitigate against further occurrences of such fraudulent or unlawful conduct.

If Airwallex reasonably believes that a change to any part of the Program will have a detrimental impact on you, Airwallex will provide you with fourteen (14) days’ notice of such change. You acknowledge and agree that such notice may be given to you:

• via the Airwallex website;

• via the Airwallex Webapp; and/or

• by direct electronic communications sent to you.

Privacy

Any personal information that you provide to us in connection with the Program will be handled in accordance with our Privacy Policy (https://www.airwallex.com/uk/terms/privacy-policy#scope-of-policy).

Governing law and jurisdiction

These Terms shall be governed by and construed in accordance with the relevant Applicable Law set out in Annex 1. 

You agree to submit to the jurisdiction of the relevant forum as set out in Annex 1, over any dispute, controversy or claim (including non-contractual claims) arising under or in connection with these Terms.
