These terms and conditions (‘Terms’) set out the terms and conditions of your participation in the Airwallex x K Dollar Promotion provided by Airwallex (Hong Kong) Limited (‘Airwallex’, ‘us’, ‘our’ or ‘we’). These Terms shall form part of any applicable agreements (‘Customer Agreements’) governing the use of the Airwallex Platform and Services and shall be construed accordingly. Capitalised terms used below shall have the same meaning given to them in the Customer Agreements unless otherwise defined in the Terms.

By participating in the Airwallex x K Dollar Promotion (‘Promotion') and/or receiving the K Dollars (‘K Dollar’), you agree to these Terms.

Who is eligible to participate in the Promotion?

You are eligible to participate in the Promotion and become an ‘Eligible Customer’ if all of the following requirements are satisfied:

(a) You have signed up as a new Customer of Airwallex and enrolled in the Promotion through our dedicated landing page during the Promotion Period;

(b) You have been onboarded by Airwallex as a new Customer following satisfaction of all requirements from Airwallex (including the onboarding know-your-customer requests) (‘Onboarding’);

(c) You have transacted an aggregate of no less than HKD 10,000 (or its foreign currency equivalent of as calculated based on the exchange rate used by Airwallex at the time of the transaction) worth of Eligible Transactions (as defined below) within 30 days of your Onboarding (‘Onboarding Period’) and within the Promotion Period;

(e) You are incorporated in Hong Kong ;

(f) You or your nominated representative are member of the K dollar program which is operated by Missions Points Network Company Limited (‘MPNCL’) ; and

(g) You are not an existing Customer of Airwallex’s affiliates at the time of enrolling in the Promotion.

If you meet all of the eligibility requirements (‘Eligibility Requirements’) above, you may nominate one of your representatives for the purpose of receiving the K Dollar awarded in accordance with these Terms. Airwallex reserves the right to refuse any Eligible Customers their participation in the Promotion for any reason.

What is the Promotion?

During the Promotion Period, Eligible Customers are entitled to a one-time award of 2,000 K Dollars upon making an Eligible Transaction within 30 days after account activation during the Promotion Period.

How and when will you receive K Dollars?

Upon satisfying all the Eligibility Requirements and making the Eligible Transaction, we will send you a redemption form to fill in (‘Redemption Form’) to the email address that is associated with your Airwallex account no later than 30 days after the date after you completed the Eligible Transaction. In the event you fail to submit the Redemption Form within the promotion period, no K Dollars will be credited to your account. Please fill in all the required information in the Redemption Form. The submission of Incorrect information, missing information or no information will result in no credit of K Dollars to your account.

We will aim to have the relevant K Dollars awarded under the Promotion credited to the Eligible Customer’s designated K Dollars account by the end of the calendar month following the submission of the Redemption Form.

For example, if you satisfy all Eligibility Requirements and make an Eligible Transaction on 2 April 2024, we will send you the Redemption Form by 3 May 2024 and aim to have the relevant K Dollars credited to your designated account by 30 June 2024 provided that you submit the Redemption Form by 30 June 2024.

Please note that the late submissions of the redemption forms results in no K Dollars being credited to your designated K Dollar account. It is your sole responsibility to provide your current email address and correct K Dollar account number. Airwallex accepts no liability for any issues with (i) respect to the delivery of any emails; (ii) receipt of your redemption form or (iii) your submission of an incorrect K Dollar account number and our credit to such number. In the event that you submitted an incorrect K Dollar account number, Airwallex has no obligation to subsequently credit any K Dollars to your updated K Dollar account number.

What are Eligible Transactions?

'Eligible Transaction' means an Eligible HKD Transaction or Eligible Non-HKD Transaction but excludes any Excluded Transactions

'Eligible HKD Transaction' means a transaction made in Hong Kong dollars ('HKD') of any amount made by Eligible Customers using the Airwallex Card.

'Eligible Non-HKD Transaction' means a single non-HKD transaction made by Eligible Customers with an amount of USD 30 or above using the Airwallex Card.

Eligible Transactions excludes transactions expressly prohibited under and not supported by our Services pursuant to the Customer Agreements and/or the Acceptable Use Policy and transactions of similar nature (‘Excluded Transactions’). Excluded Transactions further include unposted, cancelled, suspended, refunded, unauthorized transactions and any other transactions as designated by Airwallex, in its sole discretion, from time to time.

When is the Promotion Period? ‘Promotion Period’ means the period that commences on 15 April 2024, 00:00 Hong Kong time and ends on 30 June 2024 23:59 Hong Kong time (both dates inclusive).

Is there any cost to participate in the Promotion?

Airwallex does not charge you any costs, fees or expenses to participate in the Promotion.

What are some other restrictions you should know?

The issue, redemption and usage of K Dollars shall be governed by K Dollar Program Terms and Conditions. Airwallex accepts no liability in respect of the goods and services provided by MPNCL or any additional offers which MPNCL may or may not offer.

The eligibility of transactions for the purpose of the Promotion is determined by Airwallex in its sole and absolute discretion from time to time. Airwallex shall not be liable to determine the eligibility of any transactions before they are made by the Eligible Customer.

The Promotion is not available in conjunction with other offers, packages or promotions as may be launched by Airwallex from time to time, unless specified by Airwallex. Each K Dollars account can only receive the relevant K Dollars awarded under the Promotion once.

If any Eligible Transactions are subsequently cancelled, suspended, frozen or refunded such that the relevant Customer fails to satisfy the Eligibility Requirements, the K Dollars awarded will not be awarded.

K Dollars cannot be transferred to third parties or other accounts, or exchanged for any other gifts, returned or exchanged for other products with respect to Airwallex.

Indemnification

The Eligible Customer shall indemnify, defend and hold harmless the Airwallex Group and its officers, directors, employees, advisors, agents, and subcontractors from and against any loss, damage or expense (including reasonable attorneys’ fees) incurred in connection with any claims, actions, demands, suits or proceedings made against the Airwallex Group by a third party or suffered by the Airwallex Group in connection with or as a result of the Eligible Customer’s breach of this Agreement, failure to comply with Applicable Law or the Eligible Customer’s use or misuse of the Promotion.

Termination and changes

The Promotion expires on June 30, 2024, 23:59 Hong Kong time, unless otherwise extended or shortened by Airwallex. Your participation in the Promotion is not guaranteed and may be revoked at any time in Airwallex’s sole and absolute discretion. Airwallex reserves the right to amend these Terms or cancel, suspend or amend this Promotion (or any part of it) at any time without prior notice. Should any disputes arise, the decision of Airwallex shall be final and conclusive.

For the avoidance of doubt, Airwallex reserves the right, at our sole and absolute discretion, to suspend or cancel offering the Promotion to you if we suspect that you are abusing or using the Promotion in a fraudulent or unlawful manner or for a fraudulent or unlawful purpose or if you are in breach of any of these Terms or the Customer Agreements or any of our terms and conditions you have agreed to with Airwallex. During the Promotion Period, in case of any fraud, abuse, reversal, cancellation or charge back of transactions in respect of which the K Dollars is awarded, Airwallex reserves the right to debit or request MPNCL to debit the relevant amount of K Dollars from the Eligible Customer's K Dollars account without prior notice.

Eligible Customers are required to keep records of their relevant Eligible Transactions. In case of any disputes, Airwallex reserves the right to require the Eligible Customer to provide such records or submit relevant documents or proofs for verification purpose. Submitted documents or proofs will not be returned. The decision of Airwallex regarding the eligibility of relevant transactions shall be final and conclusive.

In case of any conflict between these Terms and Customer Agreements, these Terms shall prevail.

Privacy & Security Any personal information that you provide to us will be used in accordance with our Privacy Policy. In addition, by participating in the Promotion, you expressly consent that any personal information that you provide to us may be shared with AML for purposes of the Promotion and all related administrative actions in connection therewith.
