FEDEX x AIRWALLEX Promotional Campaign Terms 2024

The FEDEX x AIRWALLEX Promotional Campaign (the “Promotion”) is provided by Federal Express (Hong Kong) Limited (“FedEx”) and Airwallex (Hong Kong) Limited (“Airwallex”). These terms and conditions (‘Terms’) set out the terms and conditions of your participation in the Promotion operated by Airwallex. These Terms shall form part of any applicable agreements (‘Customer Agreements’) governing the use of relevant products and services provided by Airwallex to you (‘Services’) and shall be construed accordingly. Capitalised terms used below shall have the same meaning given to them in the Customer Agreements unless otherwise defined in the Terms.

By participating in the Promotion, you agree to be bound by these Terms. For terms and conditions of your participation in the Promotion operated by Fedex, please refer to https://www.fedex.com/en-hk/shipping/industry-solutions/ecommerce/merchant-offer/tier2/agreement.html (“Partner Terms”).

Who is eligible to participate in the Promotion?

You are eligible to participate in the Promotion and become an eligible customer ( “Eligible Customer”) if all of the following requirements are satisfied in the following order:

  • You are a company incorporated in Hong Kong with a valid business registration certificate.
  • You have enrolled in the Promotion through a dedicated page for the Promotion at one of these links: https://www.airwallex.com/hk/fedex-asia-miles or https://www.airwallex.com/hk-zh/fedex-asia-miles during the Promotion Period (as defined below);
  • At the time of your enrollment in the Promotion, you are not an existing customer of Airwallex and / or its affiliates (collectively the “Airwallex Group”) and you have not, at any time previous to your enrollment in the Promotion, been a customer of the Airwallex Group;
  • You have signed up as a new customer of Airwallex and received the Airwallex Borderless Card upon being successfully onboarded by Airwallex following satisfaction of all requirements from Airwallex (including the onboarding know-your-customers requests) (“Airwallex Onboarding”); and
  • You have signed up as a new customer of Fedex via this link at https://weblets.dmz.apac.fedex.com/BaC/hk/en/edm/FullName/AW80 and successfully become a customer of Fedex (collectively with Airwallex Onboarding, “Onboarding”).

Airwallex reserves the right to refuse any Eligible Customers their participation in the Promotion for any reason and without any prior notice.

What is the Promotion?

During the Promotion Period, Eligible Customers are entitled to:

(a) A cash rebate (“Cashback”) in HKD equal to 10% of the amount of the Eligible Transactions. Each Eligible Customer can enjoy Cashback up to a maximum amount of HKD 1,000 in each calendar month during the Cashback Period, and a maximum total amount of HKD 3,000 during the Promotion Period.

(b) A one-time welcome award of 5,000 Asia Miles (“Welcome Award”) upon successful Onboarding and if you made at least one Transaction with no less than HKD100 with the Airwllex Borderless Card within 60 calendar days immediately after the date of your Onboarding with Airwallex (the “Welcome Award Requirement”).

(c) An additional 2,000 Asia Miles if you use and pay for FedEx international shipments paid using your Airwallex Borderless Card during the Cashback Period.

Eligible Customers may also be entitled to the rewards offered by Fedex as set out in the https://www.fedex.com/en-hk/shipping/industry-solutions/ecommerce/merchant-offer/tier2/agreement.html (‘Partner Offers’) subject to the Partner Terms.

How and when will an Eligible Customer receive the Welcome Award?

Upon becoming an Eligible Customer and satisfying the Welcome Award Requirement, we will send you a redemption form (‘Redemption Form’) to the email address that is associated with your Airwallex account no later than 30 days after the date when you satisfy the Welcome Award Requirement. You should submit the Redemption Form to us on or before 31 March 2024 in order to enjoy the Welcome Award. After receiving the Redemption Form from you, we will credit the relevant Asia Miles awarded under the Promotion to your Asia Miles account provided in the Redemption Form by the end of the immediately following calendar month. For example, if you satisfy the Transaction Requirement on 2 February 2024, we will send you the Redemption Form by 3 March 2024; and if you submit the Redemption Form to us on 31 March 2024, we will credit the relevant Asia Miles to your Asia Miles account provided in the Redemption Form by 30 April 2024.

PLEASE NOTE THAT NO ASIA MILES WILL BE CREDITED TO YOUR DESIGNATED ASIA MILES ACCOUNT AS A RESULT OF LATE SUBMISSION OF THE REDEMPTION FORM. IT IS YOUR SOLE RESPONSIBILITY TO PROVIDE YOUR CURRENT EMAIL ADDRESS AND AIRWALLEX ACCEPTS NO LIABILITY FOR ANY ISSUES WITH RESPECT TO (I) THE DELIVERY OF ANY EMAILS OR (II) YOUR RECEIPT OF THE REDEMPTION FORM.

What are Eligible Transactions?

'Eligible Transactions’ means FedEx international shipments paid by an Eligible Customer using its Airwallex Borderless Card during the Cashback Period.

When is the Cashback Period?

The “Cashback Period” is defined as the period of three consecutive calendar months from the date of the first Eligible Transaction made by the Eligible Customer. For example, if you made your first Eligible Transaction on 31 January 2024, assuming that you satisfy all the other requirements set out in these Terms before such date, the Cashback Period commences on 31 January 2024 and ends on 31 March 2024 (both dates inclusive).

When is the Promotion Period?

This Promotion commences on 25 March 2024 and ends on 30 April 2024 (both dates inclusive).

When will an Eligible Customer receive the Cashback?

The Cashback will be credited to the Eligible Customer’s Airwallex account on or before the end of the calendar month immediately following the month in which the relevant Eligibility Transactions are made.

Is there any cost to participate in the Promotion?

Airwallex does not charge you any cost, fee or expense to participate in the Promotion.

What are some other restrictions you should know?

The Promotion is not available in conjunction with other offers, discounts, packages or promotions (as may be launched by Airwallex from time to time), unless specified by Airwallex.

All applicable products and services from Fedex and Partner Offers are directly provided to you by Fedex. Fedex is solely responsible for all related obligations and liabilities. Airwallex is not the supplier of such products, services or Partner Offers or the description, photos or reference prices in relation to such products, services or Partner Offers offered to you, whether or not in connection with the Promotion. Any enquiry, claim or complaint in relation to the quality or availability of the products, services or Partner Offers offered by Fedex or the accuracy of any of the aforementioned information provided by Fedex shall be directed to Fedex, not Airwallex. Airwallex shall assume no liability in respect thereof.

Eligible Transactions exclude transactions including but not limited to those expressly prohibited under and not supported by our Services pursuant to the Customer Agreements and/or the Acceptable Use Policy and transactions of similar nature. Eligible Transactions also exclude unposted, cancelled, suspended, refunded, unauthorized, charge back transactions and any other transaction as designated by Airwallex from time to time.

The eligibility of transactions for the purpose of the Promotion is determined by Airwallex in its sole and absolute discretion from time to time. Airwallex shall not be liable to determine the eligibility of any transactions for the Promotion before they are made by the Eligible Customer.

The Cashbacks may be reversed if any Eligible Transactions (in full or in part) are subsequently, cancelled, suspended, frozen, reversed or refunded. Cashbacks cannot be transferred to third parties or other accounts, or exchanged for cash or exchanged for any other gifts, returned or exchanged for other products or services.

Airwallex will not accept any liability if any information submitted by any third party partners, service providers, network providers, software and applications (including but not limited to Visa) to Airwallex has been delayed, lost, invalid or unidentifiable due to any technical problems of the computers or networks. No person other than the Eligible Customer and Airwallex (includes its successors and assigns) will have any right under the Contracts (Rights of Third Parties) Ordinance (Cap 623) to enforce or enjoy the benefit of any of the provision of these Terms.

Indemnification

The Eligible Customer shall indemnify, defend and hold harmless the Airwallex Group and its officers, directors, employees, advisors, agents, and subcontractors from and against any loss, damage or expense (including reasonable attorneys’ fees) incurred in connection with any claims, actions, demands, suits or proceedings made against the Airwallex Group by a third party or suffered by the Airwallex Group in connection with or as a result of the Eligible Customer’s breach of this Agreement, failure to comply with applicable law or the Eligible Customer’s use or misuse of the Promotion.

Termination and changes

The Promotion expires on 30 April 2024, 23:59 Hong Kong time, unless otherwise extended or shortened by Airwallex. Your participation in the Promotion is not guaranteed and may be revoked at any time in Airwallex’s sole and absolute discretion. Airwallex reserves the right to amend these Terms or cancel, suspend or amend the Promotion (or any part of it) at any time without prior notice. Should any disputes arise, the decision of Airwallex shall be final and conclusive.

For the avoidance of doubt, Airwallex reserves the right, at our sole and absolute discretion, to suspend or cancel offering the Promotion to you if we suspect that you are abusing or using the Promotion in a fraudulent or unlawful manner or for a fraudulent or unlawful purpose or if you are in breach of any of these Terms or the Customer Agreements or any of our terms and conditions you have agreed to with Airwallex. In case of any fraud, abuse, reversal, cancellation or charge back of Eligible Transactions in respect of which the relevant Cashback is awarded, Airwallex reserves the right to debit the equivalent amount of the relevant Cashback from the Eligible Customer's Airwallex account without prior notice.

Eligible Customer is advised to keep records of the relevant Eligible Transactions. In case of any disputes, Airwallex reserves the right to require the Eligible Customer to provide such records or submit relevant documents or proofs for verification purpose. Submitted documents or proofs will not be returned. The decision of Airwallex regarding the eligibility of relevant transactions shall be final and conclusive.

In case of any conflict between these Terms and Customer Agreements, these Terms shall prevail.

Any personal information that you provide to us will be used in accordance with our Privacy Policy.

Governing law These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region.
